It really doesn't make sense. I read about a woman in NYC who was mugged on her way to an abortion clinic. The mugger stabbed her in the stomach and the fetus died. The mugger was caught and charged with infanticide.
If I had to speculate, I would say that, in general, people believe that abortion is morally wrong, but that the government should have no right to regulate morality. If the fetus is still alive, there is always the chance that the mother could change her mind, but once the fetus has been murdered without the mother's consent (i.e. violently), the choice is taken away from the mother.

Because abortion isn't against the law. I have a neutral standpoint on the whole pro-life/pro-choice thing. It's just that right now, they don't see killing a fetus as murder because it's a choice, but if a woman was planning on having the baby or if it was advanced in the pregnancy stages, then it'd have to count.

Abortion is a choice. Most doctors won't perform an
abortion after 8 or 9 weeks of pregnancy.
Lacy Peterson was 9 months pregnant. A baby can
sustain life on it's own as early as 6 1/2 or 7 months.

I am well aware of this ridiculous, abysmal double standard! How can the existence of life depend on whether we want it or not? In my opinion, it just proves that people are lying to themselves, telling themselves there's not a life growing inside them. There is just no way to justify it in my book. It proves how insane it is to have made abortion legal. It's legal murder. They give you drugs at a hospital, to literally kill your baby, but if you do it yourself, you're charged?? Nuh-uh, no way does that make sense.
Abortion is legal up to 20 weeks, or at least that's the latest news I have.
WHY is legal abortion a woman's choice? I ask you out there prochoice, if a person kills their horrible, abusive father who doesn't deserve to live, they're still charged w/ murder, right? So, how is it ok and justified to take the life of an innocent bystander in your choices, or possibly even someone else's sins, such as sexual assault? It's not ok to kill your rapist, so why is it ok to kill the innocent life produced?

Very good question. My guess is that legal abortion is seen as a woman's choice. Since the death of the unborn child of a murdered woman is not the woman's choice then it is considered involuntary. Does bring up a very interesting moral question.

Of course, it's ridiculous. We live in a confused, compassionless, throw-away society. Life only has value if we say that it has value. So the elderly and the sickly had better watch out! They're next. The justification for terminating them will be that "they wouldn't want to live this way" or "they're costing us too much money."

very interesting. I believe that the double standard stems from a woman having control over her body. the point about it being a life only if she decides it to live can also be argued becaus emany do not consider it a life untill it is able to breath on it own etc. very good arguement. should be written into a college paper if you ask me.

You know, I have the same questions
it is a messed up system and the judges have too much control and I believe it is from twisting the truth in so many ways until it is just so much confusion
it doesn't make any sense

Anyone that terminates a womans pregnancy against her will is guilty of murder and if they kill her and her unborn fetus, that is double murder.

You should post this in the "Law & Ethics" section. Not a law enforcement question. Remember, police only enforce the laws... not make them.
