will she have problems coming back to the US? She has a visitors visa and we want to marry now here in the US while she is visiting me, but we will go back to her Country and get married, will there be a problem when we come back to the U.S.?

If she came here with a visitor visa and got married within 60 days she will have a problem later on. I would advise you to get an immigration attorney who would be more knowledgeable about thing like this that any of us combine in Y!A.

I did it myself - I had a visitor visa and got married within two weeks after I got to the US. Now, after 7 years in this country and passing citizenship test, I still am not sworn as a US citizen, because of that "boo-boo".

If I were you, I would wait for 60 days at least and then get married. But I still would consult with an attorney. I am sure you have one in your area.

OK, Here it goes: I married a Canadian she crossed the border as tourist and a week later we were married by a justice of the peace.

A week later I filed for her permanent residence I130 and since I am an American citizen she was approved with in a month, she received a stamp in her passport at the Boston INS office, with that she could go to Canada anytime and come here as legal resident.

I would find the laws of your state about marriage and get married here, no need to mention that you are planing a family wedding in her country of origin.

My brother-in-law came to the US on a fiance visa and I married a Indian who later got a green card, but the rules change often. I would visit this web site or contact an immigration attorney.

Why are you getting married twice?

EASY WAY:
If her vistor visa is still current, you can take her and your financial documents, ie tax returns, bank statements, to her country and marry her.

The US embassy or other agency dealing with US immigration in her country will need evidence that you are US citizen, this is a legal marriage and you are financially capable of sponsering her in US and not end up collecting welfare.

Paper work process will take weeks if not months depending how sufficient you have compiled your paper work.

Afterwords, she will get a package to come to US, and upon arrival at US, she will get a temporary green card in couple of weeks. If everything works out, you will need to apply to lift her temporary status just before 2 years from her arrival date.. (Sounds pretty easy, why do illegals do it the illegal way?)


HARD WAY
If you marry her in US, there is a long process of going through changing her vistor visa status to termporary residence. Immigration will need you to prove that you are truely in love and the marriage is legitimate, not one of those fake marriages.

She will be in line with other green card applicant in the US, and this process will take years.

marry her and she becomes a citizen so i dont think u should have a problem coming back with her.
