relationship which resulted in a physical fight in which we both hit each other. the police were called and i was arrested, after questioning the police said that i was to be charged with common assault and rape. she told the police that i had raped her the previous week, which was a lie. at court i was fined for the assault but the judge threw the rape allegation out as he stated it appeared that the allegation of rape was as a direct result of a disgruntled female. i think that she should have been prosecuted for the false allegation, but the CPS stated there was no evidence either way of what happened so the matter was dropped. what do you think.

First let me say how sorry I am that you had to go through that experience. Secondly, as a woman I am deeply offended by other women who abuse the word rape. Too many times women who are really raped - either by someone they know or by strangers have a hard time coming forward for the help they truly deserve and need. While other women mis-use the word rape for a multitude of other reasons and confuse the issues or flat out lie for the own selfish reasons. They do not care or realize that every one is affected when they do this. Men who are falsely accused have their lives -- reputations, jobs/careers, families and sometimes safety ruined. Almost always with no recourse or restoration to their former lives. And the women who are involved in a false accusation of rape -- nothing happens to them. It isn't RIGHT. Women have a responsibility to themselves and others. If a woman is raped she should report it, however the charge of rape is so serious it should not be used lightly, or out of spite.

I can speak from personal experience that the whole judicial system stinks!! I was charged with making a false statement, and it wasn't false - and my attorney said the state had the burden of proof. They had to prove I was lying, not to worry. But in the end, there was plenty to worry about. The system actually holds you guilty - and you have to prove you innocence, which I am sure you now realize, too.

Yeah, she probably should have been charged for false statement, but it would be hard to prove because you guys were in a relationship. That's why they didn't want to bother with it.

The fact that she was able to ruin your life doesn't matter to the system, and that's why I say the system is broken!

wow...it is so wrong that the cops take the female point of view automatically, the charges were dropped, basically the USA's way of saying YOU are in the right.
You can pursue deflation of character charges against her, and also filing a false report..better yet, move on and live your life with a good woman!

I think they, and anyone else who lies to get someone else in trouble, are crap and should be thrown in jail. However, in your case CPS was right. They do not have enough evidence to convict her. So, while she deserves to go to jail, under our system she will not.
