Had for about 1 hr. now and have not seen him use the litter box yet.

testicles are very tiny.

Checking if a male cat is neutered is simple, since it takes surgery to neuter a cat you should be able to notice a scar on the bottom of his belly, and if he doesn't have one, he may not be neutered.

Try This:

You went on to say, "I've just came across a big old tomcat or janecat can't tell the difference. How do I tell what sex the cat is before his vet visit on Thursday so I don't look like a complete ding-dong? Thanks."
Look under his/her tail. If he is a "whole" (unneutered) tom, it should be obvious. You'll see his testicles. If he has been neutered, look closely and you may see two very small remnants of the sac. Otherwise, it's probably a female. Don't feel bad, though, if you're wrong-- even the experts are fooled at times.

The best way to tell is to, well, look. As for the litter box bit, its only been an hour so I wouldn't worry about it. Just take the cat to the vet, since you found him as a stray, and have it checked out and its vaccines up dated.

A new vet looked at my neutered big male and said 'oh, he's not neutered?' because it still sort of looked like he had something down there. I told her that 'nope, they're empty' and she took another look and agreed.

SOME male cats look like they might still have something in there, but they'd be flat. If they're a pair of obvious round balls, you've got an intact male.

if he does not go missin alot as in 2 find a female cat he is neurted

Check inbetween his legs in 'that area'. If he is missing his two testes he's nuerted, or if thweres a scar there he is.

Do you see his testicles? If so, he's not neutered.
