In the USA, it is not currently illegal to burn the flag. To make it such, an amendment to the Constitution would have to be passed as the Supreme Court has ruled that it is a protected form of speech to burn it.
However, such an amendment might raise the ire of groups such as the American Legion, Veterans of Foreign Wars, and other such groups, who hold flag burning ceremonies on Flag Day to reverently and respectfully destroy flags which are too badly damaged to be repaired and put back to service. Burning is considered the most honorable way to retire such a flag according to the Flag Code.

It is considered "protected speech" by the US courts...
Not common knowledge: The Supreme Court case that originated from a protest at a political convention in Dallas, Texas created an uproar in the prosecutor's office. Several people wanted to file a charge against the defendant for "building a fire without a permit" rather than the specific "flag burning" statute which was ultimately filed. Both charges were the same "level" under Texas law.
Ultimately, the decision was made because the prosecutor wanted the potential to argue the case before the Supreme Court, which would have never accepted it with a charge of building an illegal fire. This option would have left the guy to pay his fine and maybe get a few inches on page 20 of a local newspaper rather than the lead story on national evening TV news.

No, and it never should be. Ironically, the ability to burn a flag without consequence is the best evidence that the flag still stands for freedom, at least to a limited extent.

If you are burning it as a protest, I think it is horrid.
If you hate our country so much that you want to run our flag as a joke, I think you might want to move to a Communist or a 3rd world country where you are not free, as you are here.
Then you might appreciate the men and women who died so that you could have rights here that you do not have elsewhere.

It is not illegal to burn the U.S. Flag in desecration. But to me and in my opinion, anyone who desecrates the flag in any manner is not a true American citizen and does not respect those who have fought to keep our country free. To me it is total disrespect to America and to all those who have served her.

No, and I served 5 years in service to that flag and would have died to protect your right to burn it. (not that I would have liked dying and not that I'm brave, I just believe we are capable of so much even though we rarely show it)
