If you were in a private parking lot (grocery store, department store, movie theater) then the insurance will not fault anyone. Your insurance will pay for you car and their insurance will pay for their car. It will still go on your record as an accident though, unless you and the other drive don't turn it in and get it fixed on your own.

I imagine so. If the other car hit the door on your sister's car, she was certainly out first. The other driver obviously did not check his/her rear vision mirror before backing out. This is under the assumption your sister was going the right way, considering every row is one-way.

Both are at fault. Neither of you were paying attention. Your insurance will tell you the same thing.
I had the same thing happen to me. The guy got out of his car and said it was his fault. Even though dude admitted being at fault (it was on the police report!) his insurance still denied me. I thought that it was his fault because I looked, backed out, he started backing out, I honked, tried to pull forward. So I was making a valid attempt to avoid an accident. He was in his HUGE truck not paying attention.

Almost every state has laws about parking lot accidents.
In almost every case, except a few obvious ones (like you weren't even in your car when it was hit), there is no liability for either party in this type of accident.
If you're in a parking lot and you get into an accident, neither person is at fault.
Your insurance will cover your car. His/Her insurance will cover his/her car.

I think this is a case of contributory negligence. Neither driver was paying proper attention. There's no way to prove who was backing first. Both drivers are at fault. Just because you're back out of a parking place doesn't mean you don't have to avoid a collision.

You are expected to watch behind you when you're backing up to avoid just this sort of situation. Your insurance companies will hold you both at fault, and your rates will probably go up. Instead of looking for someone else to blame, you'd be better off learning from this and resolving to be more careful in the future.

i guess it depends on the state that you are in. Even though it was in a parking lot which is considered private it won't matter because you were both in your vehicles. it puts both of your at fault because you were there. It sucks, but that's the law.
