I want to know if I can get a MIP for that... I mean for all anybody knows my parents were standing behind the camera...?

There is no way a video could substantiate that the bottles contained alcohol, and even if it could, there is nothing establishing you to be willfully violating the law. I would assume there is no law against you being in the same room with your parents while they consume alcohol: Wine with dinner is not uncommon.

No way the authorities could charge you with minor in possession unless they saw that you were drinking the alcohol. I have stuff like that in the backgrounds of a lot of pictures and videos but it didn't mean it was me drinking and smoking just that i was near people who were at the moment.

My understanding is it is hard to prosecute based on photographs because they also have to prove this happened in a certain state and in the United States, thus even if they could prove you were in possession of the alcohol, which seems doubtful, it would be hard to prove it happened in certain state to give the prosecutor standing to file a complaint against you. But who knows, crazy stuff happens.

It doesn't sound like you would be charged for just being near it. Perhaps if the video showed you holding a bottle. Furthermore, the prosecutor would need, as you say, a means to authenticate the video, which is to say that they would have to be able to prove exactly who filmed it, when, why, etc.

For you to be charged solely on the basis of that tape, it would have to be proved that the bottles actually contained alcohol, and that you actually drank it. The chances are very slim if it's all based on the tape.

You won't get charged. A DA wouldn't waste the time trying to bring that to court. He or she would know if you got a decent attorney, it could easily be thrown out.
