No, there is no penalty from the irs for filing late without an extension if you are owed a refund. Some states do fine you if you don't file even if you are owed a refund, Ohio is one I believe. Just make sure though that you file a return where you are owed money within 3 years of the filing due date, otherwise you can't get the refund amount. This means that refunds for tax years 2003 and before are beyond the time limit for filing and claiming a refund.

It is too late to file an extension for 2006. It is also not necessary to file an extension. If you are due a refund for 2006, just file and get that refund. The refund will go away by April 15, 2010 if you do not request it.

If you are due money in 2007 you'll just have to file as early as you can to get it after 1/1/2008.

how can the IRS owe you money unless you filed -- and if you filed why would you need an extension??? also if you were going to file and extension it has to be done prior to april 15.

get up off of your duff and file your 2006 tax return.

Whether you owe or are owed money by the IRS is irrelevant to the filing requirement laws. You MUST file a return or you will eventually be in deep do-do!

I'm curious, though, if you have overpaid your taxes, why would you not want that cash back? Or does it just make you feel good to make an interest-free loan to the government, which is what you are in effect doing?
