last night my friend was arrested right before he crossed the boarder back in to california for being drunk in public, he was no more drunk then the other people around, and wasn't being mouthy or anything, but the mexican police arrested him anyway. they said 4 or more days, can they just hold him as long as they want? is there anything i can do? like mexican bail? i have heard so many horrible things about the mexican police and the jails, i just want my friend home safe, any advise??? please!!

If I were you I would stop now and take the advice of VAGO, he sounds as if he knows what he is talking about! or you could...
Call an attorney in America, I would not rely on an attorney out of Mexico without first being refered by a well known and established attorney that practices near the mexican border as I am sure they probably have dealt with this before and know who to contact and what if anything you can do.Even in America you should always look for a referal this is not meant in any way to say that mexican people are any more capable of corruption that American people.
You want a criminal attorney and you can usually find one that will talk to you about whether or not you need an attorney at all and what they can or cannot do for your friend without paying anything up front.
You will be looking at about a $2,500.00 to $5,000.00 for a retainer fee if you want to persue this.
At the very least you can get info that may put your mind at ease.
But if I were you I would not argue with anyone re: your friend so long as he is in jail there, I have heard they will prolong the time and make the treatment extra special if someone ticks em off. But I do not know this to be fact so let that scare you, just use precaution when dealing with the authorities, here and there!

Yes you can. If he has been arrested on charges of any criminal behavior, the prosecutor can't hold him for more than 48 hours before he files legal action against him. Anyways, it seems that your friend was arrested due to an administrative offense, therefore, he can not be held in jail for more than 36 hours. Administrative laws change from city to city, but as a general principle I can tell you that there is the possibility of commuting administrative imprisonment for a fine, so you have to go to the police station where he is being detained and ask the judge to commute the punishment. If none of those work, there are always lawyers around those detention places willing to file an amparo claim for 2000 Mexican pesos. That procedure will get your friend out of jail in one day at the most. Hope I could be more helpful but I don't have the details of the case.
By the way, call your local embassy or consulate and don't try anything foolish as bribing the police by yourself, they will know you are foreign and will take a lot of money out of you or get you in jail also, instead hire a local lawyer and let him do it himself.

First thing I recommend is crossing back into the U.S. and talking with the border police, explain your situation. I'm sure they are more knowledgeable than me or others in yahoo answers regarding this situation. You can always try bailing him out, but be warned when the Mexican police see a gringa Americana, they think lots of money. If you don't speak Spanish maybe you know and trust somebody that does, it would be best to have them deal with this situation for you for a small commission, I recommend trying to find a Mexican to do this for you. Above all, treat the Mexican police with respect, being disrespectful will only make it worse..

Nope he's in there baby, You might have a chance bribing the guards. But he will probably have to serve his time.
Why do people think that they can go to a foreign country and do anything they want.
One day many years ago we were in Tijuana, and we were walking down the street, carrying a large wrot iron plant stand.
a mexican lady passed by us then started screaming that we had hit her with the stand. Of course you know that they have Police standing on nearly every corner with big guns. He was starting to approach. She was screaming like a banshee. My husband finally had to hand her $10.00. She then shut up and the police went about his business. You are in their country and at their mercy.

yes there is mexican bail but they are corrupt as F*%# seriously! Well just go and try and find out about how much it will be to get him back. Do you know spanish at all? I wish I could help you I'd be right there. Well just start of with $20 then go from there and see...man i feel so sorry for your friend maybe he will learn not to go drinking in mexico yeah it's cheaper and yeah bars stay open for like ever all the way till about morning but man if you don't know your ways around or how to bribe them then your screwed and just shouldn't go party to mexico.

I want to tell you something Chiquita. When there are more than one drunken person, they all go to jail. That is more money for police department. They would not have just singled your friend out of all the others. A person can be with a drunken person and be taken in with the drunk as they call it suspicion. It does happen. Call a bail bondsman, and you will be told what to do. They do not put up with open containers or disorderly/drunken conduct. Do not be so sympathetic to his plight or least you will be the one he will call to bail his drunken azz out everytime he gets arrested.

particular! I went to Cancun, have been given relatively below the impact of alcohol on XXX and took a cab to the Krystal on the top of the peninsula from the difficult Rock Cafe. It fee me 26 money.....it is friggin CORRUPT!

Near the US-Mexican border, that is business as usual, they don't even consider it corruption.
