They are evaluated differently in each state according to the laws of that state. Also, it depends on the kind of insurances that the state allows. We have NO Fault insurance in our state so no matter who is at fault your own insurance company will take care of your end of the accident. Police evaluate distanct and speed by measureing skid tracks. They also determine cause by condition of road as well as weather at the time. They determine driver alertness by what the driver was doing at the time of the accident, like drinking, smoking, cell phone, radio, and alertness for lack of sleep or taking drugs. They use various things if they suspect drugs and alcohol like walking a straight line and a breath test for alcohol levels. They even look into your eyes with a flash light sometimes to see the dialation of the pupils. They also take all eye witness accounts as well. I've seen them take out measuring tapes and measure lines and distances on the road to see how fast a person was going. They are so good at determining that, that if you say you were only going the speed limit, they will measure and tell you if you were lying or not. They usually ask each driver individually what happened unless the driver isn't coherent after the accident. They determine who had the right of way and based on the accounts they get from the drivers and witnesses, may or may not issue a ticket.

SEEKER212 pretty much has described what is done. They measure skid marks, if any, to try to determine speed. They interview witnesses,if any. Also, many states are now doing this: Fault is split between the drivers. No driver is faultless. This really stinks because your insurance company has to pay out the percentage you are at fault even if you aren't. The percentage could be 90%/10% for example. If you can get a ticket issued (even if you have to initiate it) it will help. You will have to dispute it in court though. Taking pictures will help too if you get into an accident. Take plenty of pictures of everything including the other driver and of the scene and surrounding area itself.

Well you look at the directions each of the cars was travelling in, that can sometimes determine liability. You look at the condition of the drivers, were they licensed, were they distracted or under the influence. Was there any kind of mitigating factor such as a fallen tree. You determine who had right of way in a scenario.
