There are just 4 flats here and one resident is a smoker. the other 3 residents (Owners) sometimes have visitors who smoke so they go outside -UNTIL NOW- It's virtually an open space and no-one works there!! So,can I or can I not smoke at home?

sorry,it's not quite clear. there are 4 flats-2 up +2 down.They each have a front door in the open air and not enclosed in any way. One of the upstairs flats is rented by the Council and the other 3 have now been bought. The notice is on a downstairs wall of a non-smoker!

Hi there.Not sure what your asking.Is the place your talking about part of the council's property or yours? If the council, they can do what they want.You should be able to do as you please.

Who owns the communal area? If it's the council then they can do whatever they want.

Well it depends... I don't totally understand the question, if they did put up a "no smoking" sign, then you're not supposed to, even if other people do it. It's up to you, but don't go whining if someone catches and fines you...

you can smoke in your home but not in the lobby fo the flats.
