I am a civilian that has been arrested for a dui on a military post in texas. I am trying to find out what to expect since i am not in the militay.

Well did they call the civilian cops on you?

If they did and the civil authorities took the case and arrested and processed you...its just like getting a DWI anywhere in town.

Since you are a civilian working on base your base driving priviledges will be revoked for one or two years depending on whether you consented to blood or breathe tests

If the civil authorities did not arrest you...then you are probably home free...except you can still lose your base driving...and maybe your job

It is not double jeopardy as you are in the service, it does not sound as though you are actually being tried a second time, but facing punishment for off base actions. It would be almost the same for even a civilian job, if you are per se changed with a drug crime, your civilian job could fire you. Be thankful this is not the case here. You will face punishment for things you do even on your time and even if you did through the civilian courts, because the military wants you to understand how this also reflects on them. You see when you are in the military, you must not only follow civilian law, but also the regulations of the military. Double jeopardy merely states you cannot be tried for the same crime twice. You already had your trial, and now much face the consequences both from the civilian court and your military commanders. Just like you would if you worked in a civilian job, a DUI in the civilian world could cost you your driving privileges, or other actions involved with your job.

At a minimum you will banned from driving on base. Since you got your DUI on a military base you should be taken to Federal Court and it can be considered a felony depending on how you are charged. If you are a civilian employee on base you could also lose your job.

I assume you were issued a citation. It gives the address of the Federal Magistrate that you are to appear in front of. That will normally be at the Federal Court House in the city nearest the base. You can be given a fine and you will be expected to pay it. You will be before the bench with folks like animal poachers on Federal lands and the like.

You should have been turned over to the civilian authorities and face civil criminal prosecution. Other than that you will lose driving privileges on base.

Expect to lose your driving privledges on base. Other than that, I don't know what else they can do to you.

If you're a dependant, you could be barred from base.

If you're a civilian employee, I guess they could fire you.

You will certainly lose driving privileges on base. If you are a dependent then your sponsor will get in trouble. They stand surety for your correct behavior.

You are lucky that you didn't have a car wreck or hit a pedestrian while on post. (Ft. Bliss, Ft Sam Houston, or Ft Hood)?

Most likely you will not be able to drive on post.
