I want to see the loan paperwork because there is an address there that belongs to my dad's sister. We want to know if she bought a house under our name. It came out on our credit report. What can I do?

We tried to get copy of the place but without the account we can't do anything. Even though we showed identification is there any other way to get a copy?

1. Notify all credit agencies and have it put on Fraud Alert.

2. Once you get a copy of the docs and they are fraud, call the mortgage company and inform them you are not aware of this loan and you will sign an Affidavit of Fraud. If they refuse, then you should retain an Real Estate attorney.

You may want to consult with an attorney...this could get very messy. Contact the creditor showing the mortgage and ask to speak with the fraud department. Explain what you think may have happened and request copies of the signed application and closing docs. Once you have these documents, and you are certain someone other than yourself has signed, let them know this was a fraudulent application and they now have a fraudulent mortgage. This is not going to be pretty for your aunt is she did this and you pursue it, as you should. Once you have verified that you have been victimized, you will want an attorney to move things along for you and make sure everything is done correctly; unfortunately, it could take some time to clear this up on your credit report; you have the right to post a consumer comment on your report pertaining to any account, this may help in the mean time, and get everything in writing from the mortgage company and your attorney, so you can produce this documentation should questions arise. the credit report tells you which lender issued the loan. Call them and ask for another copy ... you've 'lost' the original. Be sure it is sent to you, not to her. [You may have to appear in person at an agent's to verify that you are you.]

That loan will have the property description, as well as the recording number from the purchase transaction and jurisdiction in which the property exists. The actual property Deed will be the recording number immediately preceding the loan [or Deed of Trust].

My guess is a copy of the loan will cost about $5.

If you know the jurisdiction, the Deed and either the Deed of Trust or actual Mortgage will be recorded in that jurisdiction. Many are now online, can be searched by name of person [you], and free for downloading/copying.

I think just about any title company should be able to give you a copy of the paperwork. I did this once and it cost me around $25. To get a name of a title company call your local realtor and describe your situation.

Contact the fraud division of the bank, this is illegal..
