I'm writing a story, and in it the kid gets in a car accident. To work with the plot, I was planning on making him be a little drunk when it occurs. The kid is like 16/17, so he's obviously underage. In real life, if you got into a car accident (he's the only one involved, flipped his car or something) while drunk and under 21 would you be charged with anything? The kids gonna end up in ICU or something in the story.

The drunk driving isn't the main part of the story. I was just going to use it to help this one part of the plot. I don't advocate it or anything. I don't even know if I'll use it, because I don't want the kid getting arrested. The drunk part was actually more for before the accident. I'll just find another way to behave his behavior before the accident.

If a 17 year old gets drunk, flips a car and ends up in ICU, it would take a real hardass cop to cite him for dui.
Unless the kid dies, the cop should still do it.
Now, why don't you write a story about a teen who has stayed clean, doesn;t touch liquor, drives safely, never gets a ticket, Ot would it be too boring?

Yes a minor can be charged with DUI -at least in New Hampshire- and while the legal limit for someone over 21 is .08 for anyone under 21 it is .02, it's just a way for the justice system to hit you harder, to make you learn from your mistakes at a younger age. However, if they were under the legal limit they would probably be charged with MIP as previously stated.

I'm almost positive he would be charged with an MIP(minor in possession). I don't think they can give minors DUI's.

Another place you could check just to verify is whatever state the story takes place...look up the website for crime and punishment.

DUI and vehicular assault/homicide, handcuffed to bed or in the jail ward at the hospital. If he ever walked it would be straight into arraignment.
