One of my friends got arrested awhile ago for theft at a retail store, so I guess its classified as retail theft. Is that a misdemanor? He was thinking about joining a program at school with me but it says you can't have ANY misdemeanors, so we were wondering what this ment for him. He never served any kind of jail time or anything, just had to pay the store a fine and court fees.

The classification of misdemeanor or felony depends on the value of the theft. In California, if the theft was less than $400, it's a misdo, if it's $400 or more, it's a felony.

Also, if the amount is over $400 and he entered the store with the intent to steal, then it was a "burglary"... or.. entering a building with the intent to commit a felony... The burg can also be charged as a misdo or a felony...

If it is not criminal, then it is a misdemeanor. Those are the choices.

Retail theft depends upon the dollar amount that was taken if it is a misdemeanor or criminal.

I am thinking that if this program is asking this, your friend may not be a qualifying candidate.

Yes it is a misdemeanor. Why doesn't he be up front with
the program administrators and explain he paid his debt.

If they deny his acceptance in the program then they're nothing but a bunch of Nzi Jackbooted thugs& I'd think twice about joining their program as well.

It's called a mistake we live, learn and move on and strive to do better.

Give me a 10 pointer kid, I need it.

Depends on the value of the merchandise he stole.

It's a misdemeanor up to a certain dollar limit (usually $1000), then it's a felony.

Okay - First you have to accept that you got caught, and are being charged justly, right? After this, now you can break it down. Depending on the amount of the item "stolen" will determine the charge respectively. As far as the money, you can argue, but it probably will not go far since it was used during the commision of your crime. Your best bet would be to accept the charge, and plea for a light punishment. Expect to be served with court fines as well as your punishment. You may even be banned from shopping at the store, not sure, depends on the victim. Since it is your first offense, they may go easy on you. Good Luck.

yes. I knew someone who got busted for stealing some dvd's. It was the same thing, fines at the store and court, however, it goes on your record. He can get it expunged after 3 years though. It just sux right now trying to get jobs. Most places do not hire someone who has theft of any kind of their record. Too much of a liability.

What sort of time he served doesn't matter here. He is convicted of a crime and that crime is at least a misdemeanor if he is paying restitution and court fees.

In most states, theft in excess of $300 is considered a felony. Tell your friend stealing is not a good idea.
