Hi...and depending what state and the circumstances behind the DWI, Yes a 19 yr old can be arrested if there is probable cause. We had an incident here in Illinois not too long ago where a 19 yr old was arrested for a DWI because of the fact he killed his friend while driving intoxicated. It depends on the circumstance and what is involved. A 19 yr. old is classified in some states as of legal age or an adult so if any wrong doings they can be sentenced as an adult. If found guilty of their crime they can either be sentenced to probation or imprisonment depending again on the crime and the extent of the situation and if they had prior convictions. Answer to the first question is yes. The penalty would depend if the state in which the nineteen year old lived had a provision for under 21 DWI. The state of Kentucky has such a law and the BAC result only has to be .02 instead of .08 because of the zero alcohol tolerance for anyone under the age of 21. The under 21 DWI is a non-enhanceable offense, meaning that multiple offenses do not increase the penalties. If someone under 21 has a BAC of .08 or over, he/she will be charged with regular DWI, with all the same fines and penalties.

They get all of the fun things that come along with the DWI charge - fines, license suspension, etc., PLUS they get a hefty fine for drinking under age, which constitutes a fine and loss of license.

Yes, absolutely. Here in Washington they can get arrested for DUI if they have ANY alcohol detected since they are under 21 and therefore can not legally drink.

Whether it's legal for them to drink or not, they can still be charged if they ARE driving drunk.
They'd probably get a "minor consuming alcohol" charge also.
So, they'd have to face both charges...usually for a first offense, it's revocation of driver's license for a year and X fine and X hours community service...then whatever the sentence is for the minor consuming charge.
