This would be up to the district court judge and the district attorney. Each case is different. Being that the gun was unloaded, no prior arrest, and how cooperative you were with the arresting officer would be factors of what the intent was at the time of arrest. Other factors would be if the firearm was a pistol or if it was concealed. A concealed firearm is a charge itself. It's not illegal to own a firearm. If it's being transported in a vehicle and your stopped by law-enforcement you must advise the Officer,Deputy or Trooper upon his/her approach that a firearm is present in the vehicle. Regardless of the firearm being in plain view ! Failure to do so is also a charge. These are just some factors that would show if there was an intent. The firearm being unloaded doesn't mean there wasn't an intent because magazines are easy to load into pistols. If the firearm was a shoot gun without being altered, intent here would be greater to show. As I said, each case is different. The district judge has the last word.

Why in the world would a US citizen be arrested for being in possession of a firearm, particularly one that was unloaded? Is there more to this story?
