I have no criminal record, never struck another person in my life. I'm 39 and am a compasionate, caring person. Last night I stopped in at the super market about 10 PM. As I stood in line, I noticed a very old homess man who had three items in his hand. One was a small package of cooked ribs. He placed the cooked ribs in his hand as he pulled some money from his pocket to count it. He then looked at his items again, looked disapointed and had to place the ribs back. (he did not have enough $)

Fast fowarding, I handed the man $20 asnd told him to go get his ribs. The man was so trhankful he had tears in his eyes. Literally. As i left the store, some idiot approached me and got in my face and started yelling at me for helping "all these bums out who ruin his neighborhood." As he screamed at me, he spat in my face from his yelling. He then told me to get the "F" out f his neighborhood. Before I could catch myself I popped him in the mouth. Now he is pressing charges. What should I do?

You were provoked. You need to keep your cool next time!
If it goes to court, the worse you'll probably get is a slap on the wrist or anger management class. Unlikely you will have a record of any kind.

Worst case scenario you will lose the case and be fined a not too terribly substantial amount, maybe two or three hundred dollars. I would not spend much on a lawyer but if the case comes to court go there and calmly present the facts as you have here. This man is a hothead and will prove it in his remarks to the judge. He will become angry about the homeless man all over again and his demeanor and ire will be evident. I have been in a similar situation and simply waited for the other guy to explode and he did. I won the case but it always depends on the judge. The law is simple, if you assaulted him it is assault. The question becomes whether his verbal assault, complete with spittle was also an assault and therefore you were defending yourself. Good Luck!

That prick assaulted you first by spitting at you (if anyone doesn't believe me, try "accidentally" spitting at a cop while screaming right in his face and see what happens), so the cops should definitely file charges against him as well. Perhaps you can make some kind of a deal with the D.A. where both you and the other guy can drop the charges against each other, save the court some time and call it even. If not, I should think you'd be entitled so some mercy from the judge considering the way you were provoked.

Get an attorney, plain and simple because you assaulted someone. Despite the man yelling and spitting, in itself may be the crime of disorderly person, he never threatened you. Even if he did threaten you, he never did anything that you would have to defend yourself against that would warrant punching him. The best thing you could have done was press charges against him rather than punching him. Get an attorney and hope that the prosecutor or judge, due to the circumstances surrounding the incident, will downgrade the charges.

Call the police, if they have have not been contacted already. You would need to give a statement along with as many people that witnessed it as possible. Having someone spit on you is an assault charge. Think about all the diseases or viruses that can be passed from bodily fluids. Hitting the person to avoid that transfer of fluids sounds like "self-defense" to me. As long as nothing else happened, and the man was not hurt seriously, there should be no issue at all.

One thing to think of. Citizens don't press charges. Police do. I have been to fight calls where I look at both men and said "grow up and go home." If its not worth charging out the police will squash it.

Be true to yourself is that acliche?No but you are a decent person.I got arrested about five years ago because I was too happy.I notice that the best times in my life consequently bring on opposite bad experiences.Why does a person with good intentions suddenly become the bad boy?Hold on to your integrity and never let nasties take it away.

He's just posturing but if it goes to court, so be it. The judge will throw out the case in five minutes and give the butthead a good ol' fashion "Judge Judy style chewing out" in the process.

Once the case is dismissed in criminal court, you should then file suit in small claims court for any out-of-pocket expenses you suffered as a result of defending yourself in criminal court.

My hat is off to you for doing a good deed all around. Thank you loaning the guy $20 and DOUBLE thanks for giving the butthead a knuckle sandwich!

like what the rest say if you can the Homy Guy w/ as a witness and ask mercy for consideration to the Judge for the insult you also get for your good deeds i believe that a ''just''justice will be on a fair judgement and merciful be Polite and ask your highness pls. dont charge me much but if i have to pay a price pls. send me to a community service(you can ask this or not its up to you) as penalty to my felony because the reason was i being provoke humiliated by my charity and i expect your honor that charity will also been given to me by this court

Being homeless isn't a license to sexually attack a woman. checklist the fool to the police. As a guy, if he had placed his hand on me i might kick his sorry ***. the main suitable concern to do whilst a homeless man or woman asks you for 'spare replace' is to ignore approximately them. maximum of those adult men finally end up spending your money on alcohol or drugs besides. and that i've got heard too many thoughts of them making foul comments once you respond with 'sorry i've got not got any replace.'

Take it to Court. Even if he drops the charges- a judge or jury will never convict you. You should NOT have hit the idiot; but you WERE provoked, and the underlying circumstanses of the incident- are in your favor. You did the right thing. :) Good luck.
