Drinking And Sex?

The other day I read a question on here about a guy who met a woman at a party and they had sex 5 times that night and now was dating her and some of his friends said she was easy and he shouldn't be. A few of the people who answered said he had raped her because she was drunk at the time. They said because she was drunk she couldn't make the choice of whether or not she could have sex. Personally I don't think this is rape. Now I know some guy will get a woman drunk or slip something in their drink so they can have sex with them and some guys will have sex with a woman who is so drunk she doesn't have a clue about what is going on. When something like that goes on I agree it is rape.

Now for my questions
Do you think this is rape? If so do you think any time a woman is drunk and has sex it is rape or just when she decides the next day she didn't want to have sex? If not do you think this is a dangerous concept that a woman can decide the next day she didn't want to have sex the night before and call it rape?

Do you think this sould only apply to women or men too?

Would this legally be rape?
If this is legally rape I have to play devil advocate here and ask if a woman when she is drunk can't make the choice or whether or not to have sex. Wouldn't the same be true for someone who was drunk and made the choice to drive?

Ok the answer to your question isn't easy

1. If he was sober, and intentionally tried to have sex with her because she was drunk...then it's concidered date rape

2. If they just met up started fooling around and wound up having sex, then it's called a drunken hook up and they happen...a lot. Is it rape if you and your gf get drunk and go at it like bunnies? No! It's called drunken sex and that's all it is.

3. I've been drunk, I've been very drunk. I can make a choice, at that time I very rarely care about the outcome of that choice so it makes the poor choice easier to make, now given that they are now dating, I'm assuming that she didn't have a problem with and in fact most likely enjoyed the sex so the point is mute.

4. If both were drunk then again it's called a drunken hook up and again this happens.

People who call her easy, whatever just because she slept with him right away doesn't mean she always does it. She just happened to be really horny and really uninhibitted. There's nothing wrong with concensual sex between two people. I try not to have sex with drunk girls for the first time, but some have actually had sex with me while they were drunk without me really knowing it and then stated later on that they were. So did I take advantage of them? Did I rape them?

I don't know about legally, but that's not rape. Unless he was shoving a funnel down he throat and feeding her whiskey, then he really did nothing wrong. Most people (all guys), go out and drunk to try to have sex. And if they had sex 5 times, I'm sure she wanted to do it too.

People that think that is rape maybe here stories about how a girl had too much to drink at a party and ended up having sex with some jerk. Well she didn't get rape, she made a bad decision. And maybe she'll learn not to have 15 shots at a party and go home with a guy that's probably been hitting on her all night. There is one thing on his mind, everyone knows this, and so does she.

And if you don't think guys have sex with chicks they don't want to have sex with when they are drunk, you're wrong. I have literally told a chick (a very very ugly chick) that, "I don't want to have sex with you," when I was drunk, and she just kept grabbing my sh*t. I ended up having sex with her and regretted it for a few days. But unlike women who think that when they make a bad decision, it's the end of the world, I got over it.

Anyone that thinks that someone that has sex 5 times with a guy when they are drunk, then starts dating them afterwards, was raped by that guy just because they were drunk are ignorant. They don't know what's going on at parties.

I'm not saying that there aren't scumbags out there that take advantage of girls, but just because a girl is drunk when she has sex, doesn't mean it's rape.

If she was absolutely out of it and paralletic then I would say it was abusing the situation, but if she was just drunk then chances are she would still be fully aware of what was happening, and allowing it to happen. If she protested and said no at any point, then it could be considered rape because being drunk she would probably not have her normal strength to keep the man off her, but if she did not protest then I would say she was willing. I'm not sure about women raping men though, although I know it does happen, it's usually the man that makes the move by entering the woman, and not the other way around.

Rape for sure, many women have a very low tolerance when it comes to drinking alcohol and may experience a blackout. In which case she didn't have a clue of what was happening to her. So why take that chance, and their is another thing to think about what if she had a std ,herpes, You being foolish would catch it too. If you are a real man you would let her sleep it off.

It's rape when... there was no explicit consent or when she was legally inable to provide informed consent. When drinking, this varies based on the individual and the state of intoxication. Determination is based on facts and facts can be difficult to determine after the fact. If she say's it's not rape, there is not much of a case. If she say's it is, then the investigation determines the facts, etc.

Alcohol shouldn't let ANYONE off the hook for their actions. I have no pity or respect for a girl who claims she did it because she was drunk. If you want to have sex, fine. But don't make excuses later.
