I think they should rewrite the law and make it so that a child born in this country by an illegal does not get automatic citizenship.
That's like if I bought a car that was stolen, it would be taken from me or if I had money I made from dealing drugs it would be seized. Why reward an illegal because they ran the border and had an illegal kid here?

Yes, lets change the law. Justsayso is correct. The 14th amendment was not intended to give citizenship to the children of illegal aliens, so you don't need to change the constitution, Congress just needs to pass a law declaring the children of illegal aliens are not to be given birthright citizenship!

Our present policy encourages the violation of immigration laws by automatically granting citizenship to children born to illegal aliens. Families enter the United States illegally for the purpose of giving birth to a U.S. citizen. These anchor babies then serve as the basis for additional immigration of
family members.

Most other countries do not have such a policy. Our system rewards those who are abusing our generous immigration laws.

It is also very costly. The mothers gain access to a multitude of costly medical and social services for their children. These illegal immigrants are then allowed to remain in the country. Most of these illegal aliens are poor, so that they are able to gain welfare, Medicaid, food stamps, and other gifts from our state and federal government. In effect, the U.S. government is subsidizing "Cheap Labor" for the multinational corporations that have zero loyalty to our country.

This is a serious issue that deserves serious conderation.

"How big is the anchor baby phenomenon? It has been estimated that about 165,000 anchor babies are born (and automatically granted citizenship) each year. It might actually be higher. The exact figure is uncertain because all hospitals and physicians receiving federal funds are forbidden from inquiring as their patients' legal status. In other words, the U.S. taxpayer is financing medical care for illegal aliens, and those providing such care can't even ask if patients are legal or not! The state of California has a particularly liberal program to reward illegal aliens which includes free pre-natal care and delivery, and it's no surprise that 60% of babies born in LA community hospitals are born to illegals. In 1994, a majority of California who went to the polls voted to end such nonsense. But the will of the people was placed under a judge's restraining order until a later state government, at the behest of the president of Mexico struck it down."

It's not a matter of re-writing the law. It's a matter of amending the Constitution.

Citizenship by birth is not something Congress enacted by statute. It's in the plain text of the 14th Amendment.

But if you want to amend the Constitution, go ahead. How would you re-write it? Both parents must be citizens? One must be a citizen? What about adoption? What about foster parentage? What about if the parents die before the child is born? What about if the parents become citizens a month after the child is born? Where would you draw the new lines? I'm asking seriously, not as an attack. Changing the law is fine..... but have you thought about what to change it to?

The intent of the 14th Amendment was to address citizenship of freed slaves and their descendents. The Supreme Court initial cases involved children of parents legally here, or children of citizens born on foreign soil.
Interpretation of jurisdiction by the Supreme Court found no distinction between legal and illegal aliens. I feel that was a judicial error, especially in view of the fact that many illegal aliens appeal for assistance from their home nation consulates to help fight deportation orders. They cling to their old jurisdiction and have not fully submitted to US jurisdiction.
Nations that diplomatically protest and/or provide aid to illegal aliens are affirming their jurisdiction over the illegal aliens.
Most European and Asians have abandoned such birthright laws.

I like boating, but find it disgusting that anyone would even remotely suggest using babies for anchors. Good god man, they will not even keep the boat from dragging in the current.

I feel that if your parents are illegal aliens then their issue would naturally be an illegal alien also. It just needs to be interpreted properly not changed.

Them and their families should be sent back. They have these babies to stay in our country and live off the system

What a shock I disagree.If the kid is born here he or she is legal citizen.
It's in the 14th amendment.It reminds me of 2004 when you conservatives wanted to make an amendment to the constitution to ban Gay marriage.And that never happened now did it?

I agree, it's time for a change! It's a well-known fact in hospitals near the borders. Pregnant women will cross the border just to give birth in the states so that her baby will have legal status. This is a stupid law, we need to change it!

One of the best things about the United States is that we don't define citizenship by blood. Creepy fascist and authoritarian countries do. If you're here, you're one of us, and it's a nice sentiment that puts the US ABOVE the crappy countries our ancestors fled. Why are you trying to ruin what's good about the US?
