Could happen, but probably not. If convicted, however, he stands a high possibility of deportation proceedings upon release from jail. (strangely, the chance of deportation is lower if he goes to state prison).

Once that person is arrested, the police does background check and the information is send to the United States Citizenship and Immigration Service. The person would be under the USCIS custody once that person is in jail. the USCIS than bail her/him or sometimes the person has to serve time and remove the individual from the country.

If it is a felony they are supposed to be, but I think deportation occurs after the trial. They aren't deported for misdemeanors.

No, just ask the overcrowded jails in California. The population out there is something like 45-60% illegals. We don't deport them, we give them a fair trial and put them in our own jails.

I would hope so.
I'm not prejudice or anything like that...
But ALL illegal aliens should be deported.
Then they can come back in legally.
The illegals are screwing up our system.
It's not right.

of course they wouldnt be.....officials would rather have the tax payers keep supporting them (part of our taxes go towards the prisons and supplies for them). Look at death row...you sit there for years living it up on our dimes. Nothing makes sense in our justice system!

probably not. Sex offenders and multiple DUI illegals are not deported.

they should be deported upon completion of the sentencing.
