This is my wife name but im a dad of a 4 yr old and she will be in my custody for a little over a yr while i have temp custody of her do I have tto pay child support ??? If soo why ?

the thing is the mom only wants to give me temp custody now but child has been living with me since she was 5 months old and I have been paying child support all the time because my daughter dislikes her mother ( she crys when I take her over there ) So once I get temp custody how easy would it be for me to go to full custody??? Also the child support is done through srs because she is a welfare mom having her 4th baby with no job !! Currently I hpay 600 a month in child support 50 a month in back for my daughters birth!!

You should have full custody, you should go to the courts if you can prove that your daughter has been living with you all this time, ie neibours, family members, daycare, anything and that you support her all of the time and still pay the child support to the mother, of whom doesnt even have the child. Expecially if yall havent gone to court yet, "you can pay child support but not have a custody agreement". Legally you can keep your child with you, in the state of va, a cop will not go to one parents house and take a child to give to another parent, you have to go to the courts for the order, unless there is reason to believe that there is danger. YOur a great guy..... and that "600" dollars could go towards your daughter at your house, or a college fund

I do not think you are obligated to do so, since she will be in your care for such an extended period of time. Key words here are: I DO NOT THINK.
You should consult the courts. If you choose not to do so, get a notarized letter signed by both you and your daughter's mother stating the length of this arrangement and whether or not you will be paying child support during the time. But again, I think you should consult the court.

There's something that you have to file with the courthouse (your ex wife will have to sign) showing temp custody. If you do this, then you do not legally have to pay child support. If you do not do this, then yes, you do legally have to pay child support. Check with your lawyer or call the family court division and ask them what the form is and where to get it.

what do your court documents state?
this is what you need to go by...if there is no mention of child support, then "no"...you do not need to..and usually when you have primary custody of a child you do not pay...cause you are incurring daily expenses for the child.
however, it might be nice if the other parent pays you...you may want to look into that with your attorney.

most likely. my boyfriend has joint and we have her more (her moms a loser) and he still pays her child support. the system is for women, not men. the only thing i can suggest is to take her back to court before you get temp custody and see what the judge says

You need to file a support modification right away in order to change the judgment against you. If you are in arrears, you may still need to pay a little to get that taken care of.
