No...she would have to pay. But I wasn't there and I can't say what all the circumstances are. Did she not have insurance? If not, then you have to pay your own deductable even if she was at fault. About 50% of all drivers do not have insurance. It's a shame.
Oh, I was sitting at a yield sign waiting for about 10 cars to exit the hwy and was hit by a lady going 45 mph who thought I was driving into the traffic. I am still alive. My car was totalled. I had to have physical therapy for months, but I was in good shape, so that guy up above is wrong. Just lucky that the woman had insurance.

The lady is responsible for the accident in which you described unless you was at-fault. Almost all rear end accidents fault the driver who hit the back end of the vehicle. Are you sure that the lady had insurance? You might have to pay your deductible if the lady was uninsured as well.

Unless you are emailing us from heaven you did NOT get hit at 60, 40 or even 20 mph. If you use your own insurance to have your car repaired you will have to pay your collision deductible. Your adjuster should be able to recover the cost of repairs (including your deductible) from the other party and return the deductible to you.
P.S. - to the idiot that seems to think you can get 60 times the cost of repairs if you get a lawyer -- grow up. Insurance companies aren't afraid of some scum-ball lawyer and if you don't believe it then give it a try.

The second you got rear ended, you should remain still, calm and QUIET. Someone will cellphone call for help, they pretty much do these days.
Trained EMS will get you out of the car....TAKE THE RIDE TO THE HOSPITAL ER!! Let the doctors examine for injuries (many which aren't readily available). Have your family contact your insurance company.....then call a good personal injury attorney.
And be sure to obtain police report information on the ASAP.
Don't worry about cost here! This is a no brainer civil lawsuit case here: You were legally stopped at a red light, and this neglient driver plowed right into your car's rear end.
You get the idea. Her insurance covers your bills, dude. Tell your mom to shut up and dance somewhere. So what if you have to eat your deductable? With a good attorney, you'll get 60 times that in a sweet Civil Court lawsuit case!!!

Pay the money and get a release from damages statement and a receipt as well. Also contact the garage they had do the estimate you may be able to bargain for a little bit of savings. Paying will save your insurance company money and you as long as there is no police report. If there is a police report, send it to the insurance company as they WILL find it the next time your insurance comes up for renewal. As such they will treat it just the same no matter who pays.

Did you call the police and file a report? This must be done to take any action against this woman. The name of her insurance company should be on the police report. You can do one of two things:
1. Pay your deductible on your collision insurance and have your insurance company pay for the damages. The company can then go after the other person's insurance - if it is paid - you get your deductible back.
2. Go after her insurance company and submit a copy of the police report, your statement, and a copy of at least two reputable repair shop estimates.

You were rear-ended. It doesn't matter if you were stopped or moving, the other driver is at fault. Her insurance should cover your damages. I don't know why your mom says that you will have to pay, maybe you should ask her?
