Going to be on my police record?

Hey I'm joining the Marines after this year of school and one question I have is of my possible record.

Last December my friend was driving his truck and there was a total of 4 of us. I bought booze and when I put it in the car the police had a sting on us. I was 21 and wasn't driving and one friend was also 21 and the others 20. The cops took our stuff away and didn't arrest us and we thought we were off free. About a week later I got a notice in the mail saying we had to see a magistrate. When we went it seemed to me to be a father/son chat and he basically said your record is clean therefore we arent going to charge you but we will put you on probation for 6 months. He said if we got in trouble within those 6 months they would come back and also charge any of us for the night we got the sting on us. I'm a good kid (I think) and the 6 months passed without any problems in June. I need a high level security clearance for the USMC. Will this be on my record?

remember I never got arrested, they just took the booze and I had to meet a magistrate a couple of weeks later!

The police can't put you on probation without a judge's order -- in order for the judge to punish you, there has to be a charge brought against you.

They did NOT arrest you, you were not fingerprinted, taken into the police station or anything at the time they stopped you CORRECT????? Legally they couldn't because you were 21 and actually unless the two 20 year olds were drinking in your car, there WAS really nothing they COULD do to you because they could never prove you bought it for the 20 year olds NOR could they prove anyone had drank any of it---SO it would be just like having a 50 year old PARENT stopping at the grocery store and buying a six of Bud and putting it in the car with his 10 year old SON in the car with him.... No one would stop HIM or arrest him EITHER... there is NO record, you got a slap on the hand----don't worry ....HONESTLY... I know what I'm talking about here.

Sounds like this occurred in a small town community. If the cops wrote up a ticket it is on record. This would most likely be ignored by the Marine Corps as no jail time was served and there was no conviction for a felony offense. But who knows, the Marines has changed a good bit since I served in 1968-74'.

Do what LisaE said and check to see what's on your record. If the local gov't agency isn't much help try paying to have someone do a background check on yourself.

If there isn't anything nothing to worry about and you'll know exactly what to write and say if ever questioned.

If there is something on the record, petition the same court who put it on there to have it expunged from your record. Any minor offenses shouldn't preclude you from military service, but may bring up some questions if you are to be considered for dealing with sensitive information.

Of course this is on your record, they entered you into a computer and now your name is recorded forever. Even though the cops didn't technically take you to a jail and lock you up overnight, you they can still record you as being arrested. You can be arrested for anything, there is no proof, conviction, or reason required, and arrests show up on your record forever. They aren't just going to give you a chat and let you off the hook.

most likely since they had to have record of it in order to prosecute u if u did in fact break the 6 month probation. However, i dont think you should worry about this, you were 21 years old, legal age to buy alcohol and u were't driving drunk or anything, so dont worry about it.

As long as you never had to appear in court and were never officially charged with anything your ok and it won't appear on your record. Good luck in the usmc!!

Try going to your county 'clerk of courts' website. There SHOULD be an option to look up public records. Check your name in there. If your record is on there...it will show up. Good luck!
