Looks like it would be a software download done through the cellular service carrier and could activate the cell phone when the remote operator wanted to do it while the phone is on or powered down.
The newer the phone, the easier it could be done.
Additionally, it may send a weak radio signal that would be picked up locally and not sent as a cell call.
***It should also be noted that ALL cell phones are glorified radio transceivers.***

Well why am I not surprised?! This is another example of out gov't at it's finest. Our gov't used to be fair, and treat us all with dignity, now we are all a bunch of peasants to them.
Where was our vote in this? Un-freakin-believable! Our gov't is once again going behind our back, and doing this crap without our vote, and we can't say a darned thing about it! They have to have a warrant to do that, and they do NOT have one. They are doing this to track current Mafia gang members. Am I the mafia?! NO I am NOT! We need to overthrow our gov't. We the people of America are loosing our freedom, and it's rediculous. BTW Jason if you would look at the video, then you will understand how they do it.
Bush once was going to track computers all over the country through search engines such as Yahoo, google, etc. to see if there were any terrorists in the country. And the Judicial Branch said it was unconstitutional! Well, how is this any more constitutional than that?!

If it's true, it wouldn't be the FBI, it would be the NSA. They're the guys who handle unwarranted snooping.
The scary thing about watching Will Smith in "Enemy of the State," is that all of the gadgets depicted were at least thirty years old.
You've gotta wonder what they have now.

Newer cellphone are software operated, and used less switches than older cellphone, so by playing with a backdoor in the cellphone software, it could be made pretty easy for them to light it up anytimes they seems fit and listen to current conversations... Thats said, if FBI can do this, I can`t imagine what the CIA, DEA or NSA can do!! Its getting scary!!

I hear ya cvq3842 I too have a boring life. All they would get is an occasional "hey stop that" or Get down from there your gonna break your neck" yelled to my kids. Ah well to bad they cant watch. My kids would be on America's Craziest Stunts.

I know it SOUNDS terrible, but I never say anything over the phone or anywhere else that would be of any interest to any law enforcement agency. It may not help you to think about it that way, but it helps me.
I had a DoD Secret Clearance for 30 years. I always used to say that if anyone kidnapped me I wouldn't have anything to tell them. I had no idea how anything I did at work could help any foreign agency. So I didn't worry about anyone listening or kidnapping me ... at least for something I knew that someone else wanted to know.
You may feel like stomping your foot, pushing out your lower lip and crying that it isn't fair. Perhaps it isn't, but life isn't fair either.
Paranoia can be harmful to you.
