I am about to file for divorce from my husband (we are both active duty army) and we are only fighting over our son. Do I need to hire a civilian lawyer or will JAG do that?

NO. Jag will not assist in a civilian matter, at all. Period. End of that discussion. They will however provide a list of lawyers to contact that generally offer a discounted rate for military.

Divorce is really dependent on the state its filed in. Some states are more likely to give the mother custody, others base it fairly and on job status, pay, likely hood to maintain a stable home life. Some states will even take the child's wishes into consideration (assuming the child is old enough).

Jag can not help you get custody for your son, they can advise you of what you may get in civilian court, the ywill give you a list of Lawyers off post who can help you...
I am not sure why everyone assumes Jag handles this type of situation... also you need to go to JAG before he does if he beats you to them you will not be allowed to see Jag there on post they will refer you to other base (if there is one near by) or off post. Good luck!!

I have had 2 friends who went through the same thing both times I took them to JAG personally one I had to translate for .

The JAG Corps deals with military law cases. They do provide some assistance on civilian matters, but serving as your counsel of record in a child custody case isn't part of that assistance, even though both parties in this action are active military.

JAG does not handle civil court matters, only Military ones. you will each need a civilian lawyer.

A JAG attorney can't represent you in a civil proceeding, so you may need a civilian attorney. I suggest that you go to the Legal Assistance office on post an see what they can do for you as they do have some resources and can provide advice.

never trust the advice of yahoo lawyers, or barracks lawyers.

and to the rest of you the Jag is there to represent you in any case civil or criminal.

No. You will both have to hire a civilian attorney that specializes in family court.

JAG has enough military issues to keep them busy.

Better start talking with your husband or you are both going to become really poor really fast.

They assist you, however; you should hire a civilian attorney, because the JAG will only go so far with you, they won't represent you in such a case..

JAG doesn't do civilian matters---and child custody is a civilian matter.
Grab you a civy attorney.
