For a wait staff position in a diner, club or/ and bar Is it likely that they may not call them since these are all out of state?Also what do you do If you were not in NY legally, is there a way to verify this, even if you were born in the united states and have a social security # etc...
The people in New York may give a rude impression and even though they liked me may convey it New York style and that may lead them to think I was a horrible employee in California terms?

They will check references where ever they are from. Don't worry everyone will make allowances for New Yorkers being jerks.

Long distance calling isn't normally a concern for a business doing reference checks - and many employ a natioanl agency to do this for them.
Also, if you are a legal US citizen, you don't need to do anything when you move to another state to be there legally - it's not like if you went to another country.
And yes, I've heard that us in the Northeast can come off rude/mean sounding, but if your references are good and you do the job well it doesn't mean anything

A company will usually fax another company whether local or long distance. There are very few questions an employer is allowed to answer anymore. Most times all an employer is willing to do is confirm the dates you worked there and your job title.
