they were hit from behind by a guy who fell asleep at the wheel.
they gave him a breathalizer in the drunk tank but did not tell him what his BAC was. i am just wonering what fines would be like? and also what anyone thinks about the insurance on his rental car...would they pay for damages?

No they can't take your license, that's why they didn't. They usually go through the same process and the judge may have them surrender their license in court until all the fines are paid.

Than it's that police officer's fault for not taking their license number down. All International travelers must possess an international driver license. Speaking from own experience. I think we fall under the same law of DUI's then americans. And we too would get points into our driving record overseas!

Well, honestly - its california... you'll get a fine - and points on your driving record. Deportation would only occur if you miss the court date or leave the state before your court date. Best option is to go to the court date, and as long as you didnt run anyone over- you can blame it on racism, like rodney king, who was hyped up on several substances, going 100+MPH then resisted arrest.

More than likely, they will have to pay a fine, and then they will be sent packing. My understanding is that if someone is here on a visa and breaks a law, they are immediately deported.

your license will be taken when you go to court.if you fail to appear the ins will start looking for you and you will be deported. once deported you will no longer be able to get a visa to come to the U.S. Best bet is to leave before you go to court if your license are a switzerland license. Otherwise they will be taken.

I think the idea of extradiction for a DUI is not likely...
