Back in April 2005 i was arrested for a entering auto charge. I'm awaiting on indictment now. If the jury decides to indict me will i have to go back to jail before i go to court?

Probably not, unless you fail to surrender voluntarily on the indictment. Bail may be increased because of the increase in the seriousness of the charge(s) and, of course, if you can't make bail, you will have to go to jail to await trial or until you can raise the money. Why aren't you asking your lawyer?

It seems unlikely that a grand jury would be brought a case more than two years old. Are you sure about that?

No, indictment means that a Grand Jury has found enough evidence to charge you formally with the crime. You will then have to go to court and be found guilty or not guilty by a judge or jury.

The only kicker to this, is if you have a history of not appearing to court (called Failure to Appear) or are considered transient, they may opt to hold you.

Most things vary by state, but this is the way it works here in Arizona.

No. Indictment is not the same as conviction. All it means is that the grand jury believes there is enough evidence to go to trial.

If your case is presented to a Grand Jury who "True Bills" your case (finds sufficient probable cause to indict you) they will issue a Grand Jury Warrant of Arrest.

You will be rearrested at which time you will post any additional amount of bond. Once you've bonded out...you will appear at the given court date provided!

If you continue breaking the law, you will eventually go back to jail, especially if you keep getting caught.

if you are indicted you will be taken into custdy then and their. unless you are a celeberty
