Went to court, and the one person still confessed, but all 3 have to go to trial. What's wrong with this picture? It happened in ALABAMA.

There is obviously the potential for more information here. Even though one confessed to the marijuana being his...did the officer see all three smoking?

In Alabama the possession laws extend to what is referred to as "constructive possession." This means if it's known all three were aware of the marijuana and yet nobody did anything to remove themselves from the illegal activity...they're committing the offense as well.

So...next time you're at a party knowing illegal drugs are present....I'd present you with this caution....leave or else risk incarceration as well.

If you have further questions....feel free to email me directly.

Best wishes.

Alabama first problem. No, seriously, I guess I understand taking them all in, just because the police can't know who is doing what. But with a confession, it seems a great waste of taxpayer money to try the other two. But that's what our judicial system is for - wasting money!

It is not abnormal for all 3 to be arrested. It is unusual for them to go before the judge and all 3 go to trial, but in the trial, it will likely be dropped against the other 2.

most likey they thought all 3 of them were smokeing and are doing a drug test on them. So they might have found some of that in your freind system.
