Someone gave in a £20 note at my daughters shop, they have a special pen to mark notes to check to see if theyre real or not and when the note was marked nothing happened which means the note was real[it goes purple if not real] when the note was taken into the bank they put it under an ultraviolet light and they said it was a fake. The shop are now saying that my daughter has to pay back the money and they are going to take it out of her wages.Is she liable to pay back the money and are they allowed to take it out of her wages.

if she took all reasonable precautions, used all the tools provided by her employer then I think her employer will struggle to make that stick. If she didn't follow the established procedures then she hasn't got a leg to stand on. It will come down to whether the note passed a visual inspection that will count.

I've always thought the attempt to deduct money from employees was iffy.. but Im not convinced thats the case these days.. I think emplooyers can impose that as a term of employment.

However if your daughter fights the case there is a chance the employer may turn round and sack her, of course they may take the hit themselves if your daughter can demonstrate she took all reasonable and required precautions.

Id want to be sure that they knew the duff note came from your daughters till.. that could be interesting for the employer to prove.


So eventually I suppose it comes down to does she want to take the risk and fight it, and possibly win a moral victory but loose her job, or take the hit and look for anothe rjob elsewhere where the employers aren't such plonkers

i would have though that the shop would be able to stand the loss of £20 through their accounts.it certainly not that easy to identify a fake note. did the shop give your daughter any training as to what she was looking for? im pretty sure they cant just go taking money from your daughters wages.

I am not sure about laws in the UK but if she followed procedure for the shop by using the pen they should not penalize her. You might want to check with your labor boards as to if there are any regulations on this. Also, how can they be 100% sure that she is the one that took the note?

If they are allowed to and actually do penalize her, it might be time for her to look for another job.

If it has all happened as you say, then how would anyone in the shop know it was a fake?.

If however, she has accepted a fake and not tested it with the pen, that's a different matter.

if it is in her contract, then yes they can. it can be a verbal contract though, so if she has been told they will take back any fake notes let through then she is liable.

unless she can prove she tested the note, if not she is stuffed - sorry.
