It would be the best thing for him to do this.
Since their arrest, the moral of the boarder patrol is at rock bottom, and new potential employees is nil.

Don't you know if he does pardon them, there will be some faction, probably illegals howl about it.

No. If he gets something he wants he might append commuting their sentence a la Libby to it, though. It would only happen if it were a token to something like that horrendous immigration bill he tried to shove down our throats.

Congress should do it.

The 'crime with a gun' charge is ludicrous. Border Patrol are supposed to have guns, and are in an increasingly violent situation on the border where they daily have to be prepared to use them -- for OUR protection. The reason there is a 'crime with a gun' law is that most are considered NOT to 'need them' and would be preying on innocent society. Then, giving this nightmare immunity and a free pass to carry drugs into the country is absolutely unbelievable and literally does make me suspect corruption.

Whatever 'excuse' they have for immunity, what possible excuse do they have for giving a multiple entry pass to someone with hundreds of pounds of marijuana in their van?

Something stinks in that sector.

And legalninja, if Border Patrol can never shoot drug smugglers heading back towards Mexico when they have been ordered to stop, how will we ever catch any? When would they ever NOT 'head back towards Mexico'?

Won't happen. It would take a miracle. If he does ( which I strongly doubt) it would be about damn time. They never should have been tried in the first place. They were doing their job and it seems that the so called shot in the back did not happen. The drug smuggler was shot FACING them. They had no way of knowing whether or not he had been armed and experience shows that smugglers have become violent and there have been shootouts at our border.
His position is that he can't based on DOJ rules, the same rules he chose to ignore to commute the sentence of his stooge, Libby. Disgusting!!!
Congress needs to step up and issue a Congressional pardon for both of them, a step they CAN take. Call your state representatives and Senators and urge them to do the right thing. I will be.

No! It wasn't their territory. They shot someone going BACK INTO MEXICO. They should be shot.
