Three options.
1. Contact your local county or city health department
2. Contact your state department of natural resources (or comparable state agency that handles EPA type stuff)
3. Contact the EPA
You could also call the local police. But the average officer does not have access to testing equipment or has the training to deal with stuff like this.

Call the State EPA Office in your specific state. Go to the reference provided, try the "Web Links" and find your particular state in the list. As said by others, it is probably illegal. That determination really needs to be made by the state agency.

How do you know he doesn't have a permit from the EPA?
If you want to check, contact either your state's environmental authorities or the federal EPA, whichever handles permitting for your area.

It is against the law. It can come with a big fine and I think now with some jail time. I would check with the local police department. If they can't do any thing then they may know who.

Call the EPA it is a 25,000 fine for him and you get 5,000 or so for a reward and he won't ever be able to buy it again.
