i had my son at a young age and the father was allot older to protect him i did not add him to the birth certificate. now a year later when i reached legal age he wanted to go to court for child support. he thought the court would side with him and he wouldn't pay as much ( was paying 300) now pays almost double. the court did do the parenity test. so does he still get parental rights. he is out of state and doesn't call at all. unless he want to discuss dropping the child support.

If I understand your question about parental rights, when a woman gives birth and choose to keep her child then she has the right to make decisions for her child and what is the best for that child. If you are the father and not married to the mother but is giving child support you also have rights on the well being of your child, but different states have different laws so you need to check them out.

Well, if you are on the birth certificate, you have parental rights. Of course, mom has rights as long as the baby in not adopted out at birth. If dad is put on the birth certificate, then that says he is the father and he has rights. The only way he can ever be taken off is a paternity test that proves he isn't the dad. If there is a separation than a court will have to decide to to handle the split parenting, but that wont take away either parent rights. There are other circumstances that can change the rights, but they a lengthy and I am not sure if that is all you want. I hope I answered your question.

You would automatically have parental rights if you are the biological mother or father of the child. Other than that, the court can award parental rights.

If you have a child and you haven't forfeited your rights as a parent or had those rights taken away from you by a court of law.

If you have an order from the court stating that you have guardianship, then you have parental rights.

You have parental rights automatically if you have your own children.
