I know that pretty much all states have laws in place that prohibit sellers from selling you alcohol when you're drunk, but are there any laws in place that prohibit you from attempting to buy alcohol when you're drunk?

You can't get in trouble unless there is a cop around who will get you for public intox... and when you sell alcohol you're not supposed to sell to somebody who's already drunk (unless it's at a bar)... I'm not sure why, that's just how it is.

there is no law that i know of that states you cant attempt to buy alcohol when drunk, its up to the seller to cut you off or not to sell to you at all when drunk. you can try , and go to another place and try.
if they say no, then its no.
if yes then its ok. its up to the seller.

Any resturant/bar has the right to refuse service to anyone which includes someone they think has been over served or is already drunk. Its just a safety concern for them. If you get into an accident after leaving their establishment, they can be held relieable for any damages you cause.

I haven't heard of any, probably because it's a political football that no one wants to touch. How do you get support from your constituents for a bill that says in essence, you may be subject to arrest if you try to buy alcohol while under the influence of alcohol? It would be perceived as government saying it is legal to drink it but not legal to buy it.

Well, you can be arrested for public intoxication and if you are sitting in or attempt to get into a vehicle driving position for DUI. As far as the actual buying is concerned, no.

Public drunkenness is often a misdemeanor crime.

So if you are buying beer while drunk, I assume that you are in a public place while drunk. That might get you into trouble.

As long as your not driving there or going to a drive-thru liqour store (we have one in Miami) you should be fine. There's a law against public intox but you'd have be walking around the streets and trying to cross the street or something.

Probably not, but you could be cited for drunk in public the second you walk out the door of the bar/store I suppose.

Well, only if you get busted by the policed and charged for being "drunk in public." (And I'm assuming that you're over 21.)

If you were alone, I don't think they would do it even if it was allowed, because you probably had to drive to the store...drunk...and that's illegal. They could be obligated to call the cops if you were significantly drunk in this situation.
