In the USA you can change your name "by use" - just use the new one. Women do it all the time when they marry. Men can do it too. So long as you don't do it to defraud anyone, just start.

You might want to call your county clerk and ask how much it costs to get a legal name change. He/she will know all about it.

Note that the change will be a slap in the face to the man whose name you've carried so far. Depending on how old you are, it will be a source of constant problems. For instance, you will apply for a job as "John Smith", but have to tell your new employer that you worked for the xyz company, the abc corp and McDonald's as "John Jones", and your high school / college trade / school records are under "Johnny Jones".

In most states there's a form for your dad to sign accepting parentage. You file that at the Clerk's office in the county where you were born, then file a second form to amend your birth certificate to reflect your father's surname as your own. In some cases you have to file a Change of Name form and go through the steps to post the proposed name change in the newspaper (usually depends on your age...over 18 requires more things than they require of kids). Once that's done you'll receive an amended birth certificate and take that to the DMV/Sec of State and to the Social Security Administration. Both will change your records to reflect the new name.

In many places, you can legally change your name without going through the courts as long as you do not use the name change to defraud anyone. It is better to petition the court for a name change because you will have a court order and can easily change your social security number etc. Correcting your birth certificate will vary from state to state and will probably require you to find a lawyer. You would need proof of paternity, etc.

You will most likely simply have to file the appropriate paperwork with the courts to request a name change. It's not a big deal; it was part of the process when I was divorced, and changed my name back to my maiden name.

what you need to do is to go to your county court house and go to the public records office. There should be a sign when you walk in that will direct you to the birth/death/marrage certificate office. They will be able to direct you from there.

Good luck!

That's a job for the courts. Consult an attorney.
