That depends on where you live. In the United States it is dependent on both the state you live in and the town within the state. Start by calling your local Health Department to find out your local requirements. You will usually find them listed in the White Pages as one of the sub-listings under the name of your town.

In most states,you go in person to the Metroplitan Department of Health and apply for one. If it's a restaurant,catering business or a vehicle that will serve food to the general public,you will have to show how you keep your utensils sanitized. Also,you must have hot and cold running water to wash your hands and utensils as well.

Health department. Mine was called Inspections & Appeals. Pay through your nose, hope you don't have any critical violations, and they hand over your permit. I think mine was around $800 a year, non-transferable. Here in CA though you can transfer them or even buy them from an owner going out of business. But you'll still inspected.
