My car was hit while parked out front of my house. It is a total loss. So far the guys insurance has paid for my rental car. I got a call yesterday with the estimate of what they are going to give me for my car. They also informed me I only have the rental car for 3 more days!! Is it legal for them to take my rental before I get the check???? Shouldn't they have to pay for my rental until I receive the check to buy another car?

I asked the manager at ALL State and she was extremely rude! I asked how the could take my transportation even before I get the check and she said " well i guess your going to have to come up with a vehicle"

It would be helpful to know where u r - but, speaking from most recent experience, with ICBC in British Columbia. They consider it a goodwill gesture when they provide a vehicle for 3 more days after you are paid out!

More than likely you will receive the check within the 3 days if you agreed their figures as the check was probably processed as soon as the phone was hung up.

If you do not agree with their figures they might be within their rights to only allow 3 more days. They do not owe for a rental car while you "consider" their offer.

Unless you have had the rental car for an ungodly longtime already they should not pull the rental until you have the check in hand or at least allow for reasonable mailing time from wherever they are to you. If the check is coming from one of their offices near you, then they are probably correct with the 3 day time frame.

Either you have had the rental for 30 days or they are about to send you a check.

If they have already told you that they are sending you a check, they usually overnight it. Meaning you'll have the check in less than 3 days.

Sometimes, they will need more documentation before they issue the check. This is usually b/c they need the title or something. If they are waiting on you to send them something and you have had the rental for nearly 30 days, they will not continue paying for the rental car. As soon as you provide them with the required documents, they will overnight a check to you.

The legal requirement is to provide you with alternative transportation until your vehicle is repaired OR upon an offer of settlement if your car is a total loss (which it sounds like yours is). You have been put on notice that your car is a total and you've been put on notice to go buy a replacement. It's called you mitigating your damage at this point and not incurring additiona expenses which are unreasonable.

Call YOUR insurance company and ask what your options are. They know all the local laws pertaining to this.

Did you ask them that?
They should cover for three days after you get your settlement.
