but I also worked till mid April but then went to summer school and will be going to school this fall. also can he put head of house hold or is that just if we don't live together. we have a little one on the way

No, your husband can neither claim you as a dependent nor file as Head of Household. You never claim your spouse as a dependent for tax purposes.

Since you are married your only filing options are Married Filing Jointly and Married Filing Separately. (There's an exception to that rule but you don't qualify so I'll skip the details as they're irrelevant to your situation.) Normally you'll pay the least tax by filing a joint return.

If you file a joint return, you'll claim 2 personal exemptions on that return, one for each of you. If you file sparate returns you'll each claim your own personal exemption on the separate returns. Either way, 2 exemptions are involved.

A spouse is never claimed as a dependent, and someone who is married can't file as head of household - that's only for people who are unmarried or "considered unmarried" for tax law, which is a very specific situation that you don't fit. You can file a joint return, or file as married filing separately - under almost all circumstances, the joint return will end up costing you less in taxes. Tax rates on a joint return are better than head of household. On your joint return, you'll claim an exemption for each of you.

Congrats on the baby. Next year you'll have some additional tax breaks for him/her.

Let me add one more item to your tax file. If your child is born before the end of this year that will count for a full deduction just as if that kid had been around for the full year.

No he cannot claim you as a dependent...you need to file married filing jointly...you can get tax breaks for schooling.

Yes, you must claim married filing jointly.
No, he cannot claim head of household...as he does not yet have a qualifying child.
