Congress, under article I of the constitution, can declare war, but the president can attack any country he feels is a threat to American security for thirty days beofre he needs congress to approve the attacks

Congress has the power under Article One, Section Eight of the U.S. Constitution. But, the last time we declared war was in April of 1917 when we entered World War One. The declaration passed by the Congress following the Japanese attack on Pearl Harbor stated that, because of that attack, a state of war had existed with Japan since about 8 AM Hawaii time on December 7th.
The declaration dealing with the Korean Conflict was merely "parroting" the language of a UN Security Council Resolution issued under Chapter Seven (Peace Enforcement) of the UN Charter. The same with H. Con. Res. 99, which mirrored another Security Council resolution after the Iraqi invasion of Kuwait.

technically Congress can declare war because they are the law akers ofcourse. the president can deploy a military force up to 90 days to a crisis with out congress approval or pending congressional support for more troops. usually the president sends the marines for rapid response usually to evacuate embassies when there is truoble in a country. then if things get worst the pres politics congress on any other intervntion.
