A visitor parked illegally (the community i lived in specified that visitors are to park within certain marked area) on my driveway and got a tiny scratch when my dad backed out from garage.

She asked for $630 for repair and 3 days of car rent. Is this reasonable at all? Is my dad still at fault given that she parked illegally?

If your dad hit this car, your dad is at fault. As for the money, I'd report this to your dad's insurance company and let them sort it out.
When somebody says the other driver was at fault, they are wrong because even if somebody breaks the law, it doesn't give you the right to do it. What if some driver goes past your driveway at 150 mph and you are backing out and hit him? You have to let him pass no matter what his speed was, right? You cannot hit him because he was speeding.

Most insurance companies would fault your father because he chose to operate his car when the other car, illegally parked or not, was not being operated. Your father was the only one operating a vehicle at the time, so there is no one else who could have caused the scratch on the vehicle that was not being operated.

I think it may be reasonable amount to pay for the damages. An attorney may be able to get some of the charges reduced, but then you would have to pay the lawyer a lot more than the damages would cost, for his or her services.

Your dad is at fault. He hit a parked car. Doesn't matter if it was not supposed to be parked there, he should have been able to avoid hitting it.

i dont think your dad should be at fault being that someone illegaly parked on your driveway. your dad should be asking for $630 and 3 days of car rent if anything.

You hit a still auto, it's your fault even though the pinhead was parked there.
