Yes, it is child pornography. I remember recently reading about a case where two underaged kids took sexual pictures of each other, one of them e-mailed the pics to the other, and both were nailed for creating and distributing child porn. Even though the two of them could legally have sex, it was illegal for them to make pictures of it.

Obviously, you're not guilty of anything: you didn't ask to see the pic. However, I would highly encourage you to tell your nephew that the cops take an extremely dim view of those kinds of pics, even if everything he and his girlfriend did was consensual. It would be best if they destroyed all the pics and never mentioned them again.

If you go to the authorities, one or both of the kids may get tagged as a "sex offender", with highly unpleasant consequences for the rest of their lives. The laws may not have been designed to punish this sort of situation, but they still do apply - and child porn laws often have some rather harsh mandatory minimum sentences.

EDIT: I found a link to the story. Check the link for details. You may want to make sure your nephew sees this...

When put in those circumstances, you are not looking at it as a pervert. It is child porn, but it was thrust upon you. You should have a discussion with your nephew about exhibiting the picture, as they both could get into legal trouble.

You pretend that this is a legitimate question, but your playing this titilating little game of cat and mouse with it. We're sitting her say ... WAIT A MINUTE! The questioner is a female? The questioner is 27? And the questioner thinks a naked 15 year old GIRL is "hot"? WHAT?!?!?

Get a life.

Not if the pic is flashed at you. I wouldn't take the picture home with you. That would be possession of child porn I would think.

You claim to be an adult but your not acting like one. If he is your 15 year old nephew why havent you told his parents what he is doing? And does this girl know he is showing her pic around to people? That should be your priority, not whether it is porn or not but instead letting this kid know what he is doing is not acceptable behaviour. Saying she is hot isnt helping him respect women.

That's not necessarily. Child pornography, I'd think, is more classified as sexual acts between a child and another person (whether it be child or adult). Seeing a naked child is just a part of life. Heheh.

Hope this helps,
GK

P.S. I'm still questioning the looks of your avatar--seemingly a female--which can only make me guess. Hm.
