For a driver, the police have all kinds of tests and checks to determine whether the driver is under the influence of booze. But, it seems that a cop can just see someone "staggering" home, and throw him or her in the slammer. Is that true, or do the police need to adminster the same tests to a pedestrian as a driver before locking the drunk up?

Cops do what they want - but most are too busy to be bothered with the paperwork. So if you're in your neighborhood, and no one is gonna mug you, they'll let you go...

I think that if a person is walking home drunk than the officer won't do anything because he's not hurting anyone and it is better to walk drunk than drive drunk. However, if that drunk person is disturbing the community yelling, screaming, fighting, taking off clothes and causing a disturbance than he will prolly be stopped and thrown in the drunk tank till he or she sobers up. So to your question no they don't do tests like driving they just can tell if a person is obviously drunk and being an A$$ so just be a happy safe drunk and walk home instead of driving.

Most police officers will try to get the drunk home safe as possible because they are not going to want to do paper work after an arrest.

However, the police do not have to do the test. If the drunk is acting out of control or being a publice nusience, then they can just take him in.

no matter what the case it all depends on the person they should always refuse a sobriety test and force the cop to get a warrant in the time it would take them to get a warrant they may be able to sober up enough. Never willingly contribute to a police officer they will trump up all kinds of charges but dont get irate just politely say do you have a warrant anytime they want to do anything. They can keep you there until they get one but they cannot make an arrest without it.

If you're staggering or fall over and can't get up, or pee in public, or vomit in bushes, and they smell booze, then it's public intox and you get arrested and thrown in the drunk tank. If the cop is nice and you obey what they ask and you're near home, chances are they'll let you get home maybe with a ticket and no jail.

I believe they must do the same tests... unless you are breaking the law of course. Also if you aren't supposed to drive home drunk how else are you gonna get there?? I guess just be responsible with your drinking and this shouldn't happen. They have ot have a reason to put you in jail!

Field sobriety test and a Breath Analysis. Trust me that is all they need. Punk in Drublic!!

They do sobriety tests. And yes, public intoxication is illegal

well if you are being disorderly they can.... but being normal and walking home while drunk is better than driving.

i dont think they can send u to jail, or anything like that for walking home drunk, unless u like bother people or do bad stuff while ur drunk walking
