Terrible situation. I was backing out at the mall as was the lady across from me. Istopped after pulling out 3 ft as I saw her coming. She kept coming and coming despite honking at her. She hit my bumper. Damage was minimal, just scratches on her car, nothing to mine. She insisted on filing a report, so I called the police.

Police office shows up, mad as hellll he has to take such a stupid report. It was obvious. Three days later I view report and it blamed both drivers, despite it being 110% her fault! Stated we were both doing 15 mph??? and damges were $1000 per vehicle. I know he did this to screw my perfect driving record and insurance. How do I fight this?

Now other parties insurance is calling me asking me all these questions about the incident and seemingly trying to blame me for it?

What to do here about both the insurance, as well as police report? Now I'm going to have to report an accident when I get auto insurance? I have a perfect record now.

You do nothing. There is nothing to do.

Im sure this lady told the officer "we were both backing and hit each other" .....

If she said this.. and you said you were stopped... how is he suposed to know who to believe? Where is the PROOF that she is at fault? You dont have a witness do you?

In this situation... looks like since you had both been backing he just put you both partially at fault.

Your insurance will likely side with you and put the other driver at fault. Her insurance will likely side with her and put you at fault.. this is just what they do. Since you pay for insurance with your carrier they will believe you... and will her for hers.

Again.. there is NOTHING you can do here. It is a word vs word situation and he cant just believe you when you have no proof.

You were both backing out of a parking space. With no other witnesses, officer assigns 50% liability to you and 50% to other driver. A police officer is not an insurance claims adjuster. He guessed on the damages.

If you saw her coming, why didn't you pull back into your space instead of honking the horn?

That lady sound's pretty slick. Usually in parking lots they split the blame fifty fifty unless one of the drivers was doing something obviously wrong like cutting straight across the lot.

It will be very hard to fight unless you can find a witness that can back up your version of the story.

Golly, you could have pulled back into your space! Imagine that!

Technically, she was at fault. but you had a golden opportunity to prevent it.And you don't have to report an accident if it never happened.
