I always wonder if my brother who is 26 moved out into a apartment and had an extra room. He always says I could move in with him. I'm 13 years old and he knows that my mom is no good. She brings him and I to tears and stress. Would he ever be able to have custody of me if he had an apartment? He has his own child and a girlfirend,also.

It depends on a variety of things. Your mother may have to agree to the arrangement and she would need to give him Power of Attorney over you, so he could enroll you in school and make emergency medical decisions for you. It will probably be a lot more difficult if your mother is resistant to this arrangement. You could see about the possibility of getting legally emancipated, although you are very young for that. You may end up having to go to court and if you have enough family members that will say that your mom is unfit AND your brother can prove he has room for you and is able to provide for you, then you have a shot.

honey, i'm sorry things are so bad. i think in order for your brother to get custody of you, it would have to proven that your mother is unfit. i know that the two of you think she is, but unfortunately, it would be up to the courts. i'm sure your brother can look into getting some advice from a lawyer as to what he can and cannot do for you. whatever you do, i hope you will always appreciate your brother for what he is trying to do. i hope it all works out for you guys! good luck!

He could get custody of you but it wouldn't be easy. He would have to prove that you'd be better off with him than your mom. Maybe you could stay with him on weekends for awhile and maybe during breaks from school. And if you both feel comfortable try talking to your mom about you living with him. Good luck

IF YOUR BROTHER HAD HIS OWN PLACE, A JOB, WAS STABLE....AND WANTED YOU TO LIVE WITH HIM THERE IS A GREAT CHANCE YOU COULD.

IT WOULD HAVE TO BE CONSIDERED BY THE COURT IF YOUR MOTHER WOULD NOT LET YOU GO . THE COURT WOULD HAVE TO DECIDE...

YOU ARE AT AN AGE THAT YOUR WISHES AND BEST WELFARE WOULD MAKE A DIFFERENCE IN THE DECISION..

Would you parent allow you to move in with your brother without him having to sue for custady? If you can keep it a friendly understanding - it has less damage of doing permenant damage to relationships with your family.

If he asked for custody and you told the courts that you did want to live with him.

yes he would. What does your mom actually do? if it is mental, emotional, or physical abuse get out! You are lucky you have someone you can turn to.
