It is for phone records - the phone records are in Texas and the court issuing the subpoena is in Illinois - can the subpoena be mailed or must it be served via marshal?

When I used to work in Forgery as a Detective, I was constantly using subpoenas to obtain records from out of state banks. I would always fax them to them and they would either fax or mail me back the requested documents.

The issue for you here is if the company will actually honor a subpoena from another state. That could get sticky.

Call and see how they want it delivered to them and if they will comply. If not, then you are going to need to get an attorney to work on an inter-state case and get a subpoena from a Texas court so that it is much easier to enforce.

yes. if your in anoher state it can be mailed. but you have to get a waver of consent signed and noterized and send it back. that prooves that you recieved the supoena and your constesting it to be served at your residence or business. i was reciently served by child support transfer through the mail and i had to do this quit easy and its free.
