I think the bigger worry about hurting people who're swimming near where you're fishing would be worrying about bonking them with sinkers or lures when you're casting. In So. California, swimming is not allowed within something like 100 yards of piers for just this reason. (In saltwater, it's common to use 3-4 ounces or more of weight, and if a sinker this size whacks someone, it can really hurt.) If a hook comes off, it'll probably just sink into the sand and rust away after a while -- no problem. I think broken glass would be more of a problem for waders.
I agree with the earlier poster, that if you're fishing near (or in) a swimming area you're not likely to catch much. You'll do better near rocky outcroppings or jetties -- places with cover for fish, as well as more dangerous so swimmers stay away.

It's probably not a good idea to be fishing where people swim.
Usually beaches-- oceans in particular-- have designated swimming and non-swimming areas, usualy set off by flags or bouys. Fish well outside the lifeguard-ed swimming area, and I can't imagine you'll have too much of a problem. Personally, I've never had the issue of a loose hook poking someone's foot, but even if it does happen, as long as you're outside where people are expected to be swimming, you realy can't be held accountable for it.
Also, chances are, if there's lifeguards around, they won't allow you to fish in their supervised area, and may be useful in directing you toward an area specifically for fishing. I know at the oceans and bays by me, there's sort of unwritten rules about where fishmen go and where it's safe and oky to swim.
If you think you may hurt someone, just be smart about it. If there's little kids around, move away or warn their parents. Just don't cast right into them.
...can you imagine reeling in a fish, only to have it slap someone in the face on the way in?

I avoid fishing where folks swim. Don't need the headaches of accidentally hooking someone so I move about 100 yards from the nearest swimmer. If someone decides to take a dip in front of my fishing hook, that person is only an idiot.

I have done what you are about to do. fishing next to a swimming area is not a great idea as it will not land you any big fish. thats what i learned. it did land me about 20 normal sized/edible fish, but it wasnt all that fun.
as with the people problem, chances are you will not hook them as long as you cast/fish around them (not into them xd) if you're not sure of your casting ability then just move away from the swimming are
However if you cant than just find a clear spot and if anyone wades into the area(doubt anyone will) then either tell them(kindly) that you are fishing here, or to avoid an argument just reel in your line and move.

Yes, they probably would have swimming/non-swimming areas at the beach. Don't worry about hooking anyone in the feet. If your fishing in the ocean I recommend you use a surf rod, get a sand spike so that you can put the rod on the holder so you don't hold it for like 30mins-1hr. Preferably my rigs for the beach are gamakatsu circle hooks with clam, and a "sputnik" weight. Just sit down and relax after you cast.

I guess it happens from time to time, but not very often. One thing is for sure, when you wade in the ocean, there is no telling WHAT you might step on. Just tie your hooks well, fish and relax. Catch a BIGGUN!

Common sense question yes I know ppl do it and at many places they are allowed to fish very near swimmers but please use proper judgement and distance yourself farther away so no one gets hurt!
