I own a business and have helped several employees get "legal" It is a very expensive and complicated process for both the employer and employee. Before a worker can be certified the employer must show that no American citizen is available to perform the specific duties. To accomplish this the employer must advertise the position in the largest circulation newspaper for a period of six months, three ads per month - one of the three days must be a Sunday. So 18 ads must be run and the job must be offered at the prevailing wage for the specific area - determined by INS. Every applicant must be interviewed and if not hired must be sent a registered letter explaining why they were not hired. When I placed the ad I thought I would be flooded by applicants. The ad was for a line cook/sous chef in LA county $14.59 per hour. I ran the ad for 6 months, posted the job at the restaurant and also, by law, posted the job on the internet. I had ONE applicant in six months - she was a student at a cooking school and didn't have the required skills. My employee eventually became certified, total cost was about $22,000.00. It was an eye opening experience, but according to the immigration attorney - very typical. I don't know the answer to our immigration problems but what I have stated is 100% fact - and I kept the documentation to back it up.

You can assume all you like, but I think that the American Voters spoke VOLUMES the last time it was presented. I don't think it will, for our politicians enjoy their jobs, and don't want to lose them. And they WILL lose them if they pass that sham of a bill.
I think that Americans and those here legally to work should be offered the jobs first - since that is THE LAW!!! No bill is going to give that - it is already the way the law is. If the government would spend just half the money on illegal immigration that they spend on this stupid war, we would be much better off in the way of border security. How in the hell are we supposed to keep terrorists out of this nation when we can't even keep those with no money and resources out?
Long and short - something has to be done. We tried the amnesty thing in the 80's, with the promise of stiffer penalties to those aiding illegal immigrants, as well as toughening the border security. Obviously it didn't work - since we have a higher rate of immigration today over what was happening in the 80's. It would be different if the government did as they promised - wipe the illegal immigration slate clean by giving them all amnesty, and then followed through with the laws and holding up their end. But they won't. So why do any of it, when none of it is going to work?

It isn't going to pass at least until 2009. As for employers who employ illegals, they should be put out of business. EVERY job in America ought to be offered to Americans first. There are plenty of Americans that are in dire need of jobs. Too many unemployed doesn't help anyone. As for fair market wages/benefits, the minimum wage has not increased for over 10 years. Do you think that prices have gone up in 10 years or not? Today, I bought a gallon of milk and I paid $5.12 at the local WalMart, I know it didn't cost that much 10 years ago!

No I don't think it should really matter if the person is a citizen, as long as the hiring process is fair. The job should go to the person who will do it the best. What's not fair is paying them so little that no one but illegals could afford to live. Those that hire below the minimum wage (which is itself way too low) should not be allowed to continue conducting business. Not only is it illegal, but, more importantly, it's not ethical. If non-citizens want to work... offer them the same compensation and let them compete for the jobs.

When you say Americans do you mean only citizens born here? What about naturalized citizens? What about green card holders? When we get Immigration Reform in a couple of years American employers will offer jobs to whoever is more highly skilled for that position. That is why there are work visas in the first place.
