Last night my husband was on the way to work (night shift at the post office) and was keeping up with traffic and using his cruise control in our new car (two door coupe) (had a mini-van in front of him) on the interstate. He was stopped by a police officer. The officer sat in his car for awhile and then approached the car. At first he asked my husband if he was racing another car...which he was not. The officer immediately asked my husband where his glasses were. My husband began to explain that he had lasik and did not wear them anymore. The officer stated that he should be carrying something to verify the lasik and told my husband that he could cuff him up and put him in the back of the cruiser and take him to jail for this. He said something to the effect that my husband was lucky he was not going to arrest him. The ticket states that the officer paced him for 1 mile at 81 in a 65. My hubby was of course polite due to the fact that his father and uncle were law enforcement..

I believe there are camera systems on the interstate where he was driving. Can we get a copy of this? How do we prove he was not racing (at 9:00 at night on a busy highway) and that he was not speeding. Perhaps he paced the wrong car...I mean...who wouldn't slow down if a cop was behind them in the first place?

robocop48...someone finally admits that cops are not angelic. People are afraid of them...even on here! There are people in every profession who are jerks...it's alright to admit that cops sometimes get a little high and mighty.

ratpatrol25...thanks for the answer. Refreshing...Law Enforcement without an attitude. My hubby was paced not clocked so while he may be on camera he speed was not. I just don't think this is fair. We are law abiding, hard working citizens and I felt he was bullied by a cop in a bad mood.

The Police are like that. They like to "spread" fear and the police officer who pulled your husband over got his fix on being a bully. by the way....If the officer had arrested your hubby for not wearing his glasses the cop would have been laughed out of the police station.

OK - these are my observations, based on your question, and my advice:
1. Just because the mini van was ahead of him doesn't give him an excuse to speed.
2. If he was pacing the mini van, from a distance, it may have appeared like racing
3. I had lasik too. I went down and got a new eye test that showed I didn't need corrective lenses. Took all of 5 minutes.
I am glad that your husband was polite out of respect to his father & uncle. If the officer felt that he was racing, and your husband was going nearly 20 mph over the speed limit, yes he could have arrested him.
Before it goes to court, your husband needs to go to the DMV, get the vision test, and have his license changed.
Then he needs to ask for traffic school.
Just going in and arguing that the car was on cruise control at the posted speed limit probably isn't going to pursuade a traffic court judge. And subpoenaing the tape from the cameras on the freeway is probably going to require the assistance of an attorney, which will cost you more than the ticket.
He will still pay the bail for the ticket, but upon completion of traffic school, the ticket will be dismissed.

C'mon, if he were a crooked cop, why would he have done this ? What did he gain ? Nothing.
He sat in the car for a while to run your plate and check for warrants. The comments made in the end of your story are done with the intent of making a point. Don't do 81 in a 65... or there may be consequences to your actions = resulting in death possibly. That's all. If you weren't... well fine, did you get a ticket ? If you did not get a ticket, and were not speeding, get over it, accept that this was a mistake (cops are human too) and move on. From his point of view, better to give the warning than not.

first of all the cop should have pulled both cars for speeding, second of all he could not arrest him for not having his glasses on, in our state that warrants a ticket only. as for the cameras, unless your state uses them for checking the speed of traffic, they are only used to observe the flow of traffic on the interstate. most police cars have cameras in them, they show how fast the car is traveling when it is pulled over. the police officer can not erase the tape, it is automatically downloaded at the station,with out the tape being removed from the car.

1. He was asked if he was racing another vehicle because he was observed for the same amount of time, and distance traveling at the same speed as another vehicle.
2. If your husband no longer needs glasses, he should contact the DMV because there has been a change to his license. Failure to do so is a violation.
3. I can not answer for the attitude of another individual.

I've met a lot of crooked cops...especially in Oklahoma...sounds like your husband had a brush with one.
Don't know about getting proof but I'd plead not guilty till the cows come home.

Did your husband ask for a hearing?
If not you have no reason to be complaining here.
Find out if the officer is qualified, if his speedometer was certified (usually monthly). and if he is willing to come a testify to that.
He should bring evidence of the Lasik to the hearing
