Me and my ex boyfriends new wife are having problems. Back in last august we had a fight at his apartment where she attacked me and me and him was arrested but nothing happened to her. Then in Feb. she call my job where I was working at the court house and told my boss some lies about me saying I was calling her harassing her from work and sleepin with her husband, they let me go instead of hiring me and I know it is because what she did. So a couple of weeks ago she's playing on my phone and spreading rumors about me. So I took a picture of her off of myspace and made a poster that said something along the lines of "She has Aids and sucks dick and gave out her work phone number" then I posted a poster on her job door. They had cameras so they claim they saw me do it. When I went down to the police station I wrote a statement and admitted that I did it. She says that now shes going to sew me for slander. Do you think that this is possible? How much $ can she get? I don't work?

She can file a Defamation/Libel claim against you, but you do have a defense called "The Unclean Hands Doctrine."

Most jurisdictions have case law which states that a person who has acted badly may not use the courts to seek redress from another person who has acted badly. Some jurisdictions alter this theory and may rule for the party that has been less culpable in behavior.

If you can prove all of the things you had stated above, concerning your ex's new wife's bad acts, the judge may decide that she should not be able to use the court system to retaliated against you; the judge may dismiss the case.

Your vulgarity and obscenities aside, this sounds like either a very made up scenario or a real stupid one. The only absolute defense to slander is truth. If everything that you were foolish enough to put in writing and post on a business property on camera is absolutely true and you can prove it, then slander comes off the table. Since that would be very unlikely ya, guilty of slander and the only trouble the jury will have is determining how much actual damages and how much punitive damages to award. I would say actual damages are minimal, but punitive damages could place a judgment against anything you own or ever hope to own.

First of all, what do you do at the court house? Can't be proof reading.

Sue - not sew! Sleeping - not sleepin!

And yes she can sue you. Why would anyone over the age of 12 be so stupid?

Everyone is so concerned with getting even, having the last word, when the best thing you could have done is just leave them alone - but then that comes with maturity!

i am afraid she can ciara-after all two wrongs do not make a right. but all is not lost. if she tries to (its sue by the way) the there is a certain degree of mitigation on your part-and this should be mentioned in a full affidavit (report) to your attourney. assuming she does not have AIDS and engage in fellatio she may win a case against you but the damages (should she be awarded any) would be limited as she would be considered the instigator in your actions-but be warned you would probably be liable for your own costs which depending on how far it goes could be quite substantial. good luck.

She can sue you for libel [ written ], not slander, which is oral.
Don't you ever watch police shows? Never admit to guilt, unless they show you the proof [ bet they didn't! ] The police are allowed to lie to you during interogation.
If she DOES have AIDS and DOES s**k d**k, then it's not libel, because it's true.
Do you have any tapes or witnesses of her spreading lies about you, because you could counter sue.
Stay away from him and her!

First of all it sounds like the 3 of you need to grow up. Yes she can sue you and it is up to the judge on what she will get. If you don't have a job that doesn't matter you will still have to pay.

Technically, thats libel ... slander is spoken. What she did to you was slander.

Depending on where you are they might seek to charge you with criminal libel charges, but usually libel is filed in civil courts. You would need to check with your local court's clerk office and inquire as to what monetary limitations are for a libel suit.

You lost your job because of HER slandering you. Sue her first. Your old boss will have to testify, under oath, that she called and slandered you.

If she can prove she doesn't have AIDS you can be sued. Maybe you can mitigate damages by bringing forth witnesses who will tell about her lies about you. Even if you don't have money, she can garner part of your wages/future wages.
